Purchasers ordering wine through Daily Caller Wine should be aware of the following:
Recipients must be 21 years old or older to receive wine. All shipments of wine are delivered by UPS or a certified courier service, and the signature of an adult is required at the time of delivery. By signing for the package, the recipient is confirming that they are at least 21 years of age. Any misrepresentation to the courier is unlawful, and any violation will be prosecuted to the fullest extent of the law.
This agreement shall be governed and construed in accordance with the laws of California. Jurisdiction for any claims arising under this Agreement shall lie exclusively with the California Courts.
Binding Arbitration and Class Action Waiver
We hope we never have a dispute, but if we do, and we agree to try for 60 days to resolve it informally. If we can’t, you and we agree to binding individual arbitration before the American Arbitration Association ("AAA") under the Federal Arbitration Act ("FAA") and not to sue in court in front of a judge or jury. Instead, a neutral arbitrator will decide and the arbitrator’s decision will be final except for a limited right of appeal under the FAA. Class action lawsuits, class-wide arbitration, private attorney-general actions, and other proceedings where someone acts in a representative capacity aren’t allowed.
Taxes will be added to any shipments, where applicable.
Daily Caller Wine guarantees that all products are of good quality. Members will never pay for a wine they do not like. If members receive a product they do not like, we will replace the product in question up to 45 days from date of purchase.
Because the wines we offer are often in limited supply, orders are subject to availability. If necessary, we will replace with wines of equal or greater value.
There is no fee for membership. Members can cancel anytime by speaking to a Customer Service Representative by calling 800-239-6810. However, once the shipment has already been charged, the customer is responsible for the shipment, and the cancellation will be processed for future shipments.
There is a maximum of one introductory case per household.
Once a package has shipped from our facility it is the customer’s responsibility. Returned packages are subject to a 15% restocking fee. Daily Caller Wine reserves the right to provide store credits in lieu of refunds for returned merchandise. Shipping costs are non-refundable
